Rules
Sell-my.com Digital Giveaway Contest
1. No Purchase Necessary to Enter. Contest open to legal residents
of the United States and Canada, 18 years of age or older. Employees
and the families of employees of Toshiba, Palm and Hewlett-Packard,
their affiliated companies and subsidiaries, distributors, retailers,
and advertising and promotion agencies are not eligible to participate.
Contest starts 02/24/01, 12:01 a.m. Pacific Time and ends 06/30/01
11:59 p.m. Pacific Time. Limit of fifty entries per person.
2. Two ways to enter via the Internet; a) Click on the Sell-my.com
Digital Giveaway Contest entry link within the e-mail message;
b) Click on the Sell-my.com Digital Giveaway Contest entry link
within the Sell-my.com web site.
3. Sponsor not responsible for electronic transmissions that are
lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed,
delayed, or misdirected. Sponsors also not responsible for any
other problems or technical malfunctions, errors, omissions, interruptions,
deletions, defects, delays in operation or transmission, communication
failures, destruction or unauthorized access to, or alteration
of, entries. Incomplete non-conforming or illegible entries will
be disqualified. Multiple entries not in compliance with the Official
Rules will be disqualified.
4. Prizes: One (1) Grand Prize: Toshiba Satellite 2250XCDT Notebook
computer. (ARV $1,200 USD) and One (1) Monthly Prize: Palm IIIxe
Organizer. (ARV $200 USD) or One (1) Hewlett-Packard 215 Digital
Camera Model C8890A (ARV $200 USD).
5. Winner to be determined in a Random Drawing from all eligible
entries received. A random drawing will be held on or about the
end of each month (March, April, May, June, 2001) for the monthly
prize(s) and on or about the 07/01/01 for the Grand Prize. Random
Drawing(s) by an independent judging agency whose decisions are
final on all matters pertaining to this Contest. Odds of winning
prizes in the Random Drawing depend on the total number of qualified
entries received. All entries become the property of Sell-my.com
Holdings Ltd. and none will be returned.
6. If for any reason the Internet portion of the program is not
executed as planned, including infection by computer virus, bugs,
tampering, unauthorized intervention, fraud, technical failures,
or any other causes beyond the control of the Sponsor that corrupts
or affects the security, administration, fairness, integrity or
proper conduct of the Contest, Sponsor reserves the rights, at
its sole discretion, to disqualify and individual who tampers
with the entry process and to modify or suspend the contest. If
the contest is compromised or becomes technically corrupted in
any way, electronically or otherwise, the sponsor reserves the
right to withdraw the online transmission of this Contest and
select winners for the prizes by random drawing from among all
entries received.
7. Winners will be notified by mail or e-mail on or about the
end of each month (March, April, May, June, 2001) for the monthly
prize(s) and on or about the 07/01/01 for the Grand Prize. Winner
will be required to execute and return an Affidavit of Eligibility
and Liability and Publicity Release by 07/15/01 or prize will
be forfeited and may be awarded to an alternate winner, except
where prohibited. Prizes are not transferable; no substitutions
or cash redemption allowed. All taxes are the sole responsibility
of the prize winner. By accepting prizes, winner(s) consent to
the use of their name, likeness and/or biographical information
for advertising and promotion purposes in any and all media without
limitation and without compensation, except where prohibited.
8. By entering, participants agree that Sell-my.com Holdings Ltd.,
its affiliated companies and subsidiaries, Toshiba, Palm and Hewlett-Packard,
their respective affiliates, subsidiaries, officers, directors,
and employees shall have no liability in connection with the acceptance
or use of prize(s) awarded. Winner(s) further acknowledge that
said parties have neither made, nor are in any manner responsible
or liable for, and warranty, representation or guarantee, express
or implied, in fact or in law, relative to any prize including,
but not limited to, its quality, mechanical condition or fitness
for any particular purpose. Entrants also agree that the companies
participating in the Contest are not responsible or liable for
any damage to an entrant or third party’s computer and/or
its contents, related to or resulting from any part of this Contest.
